DAFE Affiliate Program Terms Version 2.0 Effective Date: 25 September 2026 ## 1. Program Operator The DAFE Affiliate Program is operated by: Daniel Felsinger DAFE Ifangweg 6 8610 Uster Switzerland Email: app.dafe@gmail.com ## 2. Eligibility Applicants must be at least 18 years old and have legal capacity to participate in the Affiliate Program. Submitting an application does not guarantee approval. DAFE may approve or decline applications based on legitimate business, brand, compliance, fraud-prevention or operational considerations. ## 3. Acceptance of These Terms An affiliate may not become fully active until the applicable Affiliate Terms have been accepted. DAFE records: - affiliate ID - accepted Terms version - acceptance timestamp - acceptance language ## 4. Independent Relationship Affiliates participate as independent persons/businesses. Nothing in the Affiliate Program creates: - employment - partnership - joint venture - agency authority to bind DAFE Affiliates are responsible for their own business, tax, social-security and regulatory obligations. ## 5. Affiliate Benefits Approved active affiliates may receive: - free DAFE Pro access - a personal affiliate code - approved DAFE promotional material - commission tracking - access to affiliate statistics where available Free Affiliate Pro access exists only while the affiliate remains eligible and active, unless DAFE expressly agrees otherwise. ## 6. Customer Discount The standard affiliate offer currently provides: 10% off eligible DAFE Pro subscriptions for customers using a valid affiliate code. DAFE may introduce additional promotions or campaigns. If a campaign changes the commission or discount structure, the applicable campaign terms must be clearly communicated before participation. ## 7. Standard Commission The standard commission rate is: 30% of Eligible Net Revenue attributable to the affiliate. ## 8. Eligible Net Revenue "Eligible Net Revenue" means the qualifying DAFE subscription amount actually received and successfully collected for an eligible referred customer after application of the affiliate discount, excluding where applicable: - VAT - sales tax - refunds - chargebacks - reversed transactions - fraudulent transactions - credits that reduce the amount actually retained by DAFE Payment-processor fees are not deducted from the commission base unless DAFE expressly changes this rule prospectively in the Affiliate Terms. ## 9. Example If the standard Pro Monthly price is USD 15.00 and the affiliate customer receives 10% off: Discounted subscription price: USD 13.50 If no applicable tax reduces the Eligible Net Revenue calculation: 30% of USD 13.50 = USD 4.05 commission. This is an example only. Actual commissions depend on: - the amount actually paid - tax treatment - refunds - chargebacks - customer eligibility - current program terms ## 10. Recurring Commission Affiliate commission is recurring while: - the referred customer remains attributable to the affiliate - the customer's eligible subscription remains active - successful eligible subscription payments continue - the affiliate remains eligible for commission under these Terms A signup alone does not generate commission. A failed payment does not generate commission. ## 11. Cancellation by Referred Customer If a referred customer cancels but retains paid access until the end of the current billing period: commission already validly earned from successful payments remains subject to these Terms. No new recurring commission is earned after the customer's eligible paid subscription has ended. ## 12. Refunds and Chargebacks If a qualifying payment is later: - refunded - reversed - charged back - determined to be fraudulent the related commission may be: - cancelled - reversed - deducted from a future payout to the extent reasonably connected with that transaction. ## 13. Attribution A customer is attributed to an affiliate when the production affiliate-tracking system records a valid affiliate code or other approved attribution method. DAFE must maintain reasonable records showing: - referred customer - affiliate - successful payment - commission - active/inactive status Affiliates do not receive unrestricted access to private customer data. ## 14. Self-Referrals Affiliates may not earn commission by using their own affiliate code for their own subscription or through fraudulent duplicate/self-controlled accounts. DAFE may invalidate commissions reasonably identified as self-referral or fraud. ## 15. Payouts Affiliate payouts are processed manually. The normal payout cycle is monthly. Eligible finalized commission is scheduled for payout at the beginning of the following payout period, normally on or around the first day of the month. If banking systems are unavailable on that date, processing may occur on the next business day. Payouts are made by bank transfer unless DAFE expressly agrees to another method. ## 16. Payout Currency Affiliate accounting is displayed in USD unless DAFE states otherwise. An affiliate's bank may apply: - foreign exchange conversion - receiving-bank charges - intermediary-bank charges Such third-party bank fees are outside DAFE's control. ## 17. Taxes Affiliates are responsible for determining and fulfilling their own: - income-tax obligations - VAT/GST obligations - social-security obligations - invoicing obligations - business-registration obligations - local reporting obligations DAFE may request legally required payment or tax information before issuing payouts. ## 18. Advertising Disclosure Affiliates must clearly disclose the affiliate/commercial relationship whenever required by: - applicable law - advertising rules - platform rules Disclosure must be clear and reasonably visible. Depending on language and platform, labels may include wording such as: Advertisement Ad Affiliate link Paid partnership Werbung Anzeige Affiliate-Link Partenariat rémunéré Lien affilié Affiliates are responsible for using disclosure wording appropriate to their jurisdiction and platform. ## 19. Trading Claims Affiliates must not claim or imply that: - DAFE guarantees trading profits - DAFE guarantees profitability - DAFE guarantees a specific win rate - DAFE eliminates trading risk - DAFE tells users what trades to take - DAFE provides guaranteed trading signals - DAFE guarantees financial success DAFE is a journaling, analytics, education and trading-psychology service. ## 20. Affiliate Income Claims Affiliates must not present hypothetical commission examples as guaranteed affiliate earnings. Earnings depend on: - customers referred - successful paid subscriptions - retention - refunds - chargebacks - program eligibility ## 21. Prohibited Promotion Affiliates must not: - send unlawful spam - use misleading advertising - impersonate DAFE - make false testimonials - create fake accounts - manipulate referrals - use fraudulent traffic - infringe intellectual property - make prohibited financial-performance claims - advertise in a way that violates applicable platform rules ## 22. DAFE Brand Assets DAFE may provide approved promotional material. Affiliates receive a limited, non-exclusive, revocable permission to use approved DAFE branding solely to promote DAFE under the Affiliate Program. Affiliates may not: - register DAFE trademarks/domain names - present themselves as DAFE employees - materially alter the brand to create misleading claims - imply official statements that DAFE has not approved ## 23. Free Pro Access Affiliate Pro access is an affiliate benefit and not a paid Stripe subscription unless the affiliate separately purchases a subscription. The backend distinguishes: proAccessSource = affiliate from: proAccessSource = stripe and: proAccessSource = admin_manual Removing affiliate status must not accidentally cancel an unrelated valid paid Stripe subscription. ## 24. Suspension DAFE may suspend an affiliate during a reasonable investigation of: - suspected fraud - misleading promotion - disclosure violations - security issues - prohibited claims - other material violations ## 25. Termination Either party may end the Affiliate relationship. DAFE may terminate the affiliate for legitimate business, compliance, brand-protection, abuse or fraud-prevention reasons. Upon termination: - affiliate status becomes inactive/terminated - new affiliate-code use may be disabled - free Affiliate Pro access may end - new commissions stop accruing after the effective termination date unless DAFE expressly agrees otherwise Valid commission already earned before termination remains payable unless it is invalid due to: - fraud - refund - chargeback - self-referral - another legitimate reversal under these Terms ## 26. Records After Termination Historical records may be retained where reasonably required for: - accounting - tax - payout verification - fraud prevention - legal claims This may include referral and payout records. ## 27. Customer Privacy Affiliates must not receive unnecessary personal information about referred customers. Affiliate dashboards should preferably show aggregated or appropriately limited referral information. Any personal information shown must be necessary for program administration. ## 28. No Guarantee DAFE does not guarantee: - approval - number of referrals - affiliate income - customer retention - uninterrupted Affiliate Program availability ## 29. Changes DAFE may prospectively update the Affiliate Program or these Terms. Material changes affecting existing earned commission should be communicated appropriately. Changes do not retroactively invalidate commission already validly earned unless the commission was fraudulent, refunded, charged back or otherwise invalid. ## 30. Governing Law These Affiliate Terms are governed by Swiss law to the extent legally permissible. Mandatory local law remains unaffected. ## 31. Contact app.dafe@gmail.com
