DAFE Terms of Service Version 2.1 Effective Date: 25 September 2026 ## 1. Provider DAFE is operated by: Daniel Felsinger DAFE Ifangweg 6 8610 Uster Switzerland Email: app.dafe@gmail.com References in these Terms to "DAFE", "we", "us" or "our" mean the DAFE service operated by Daniel Felsinger. ## 2. Scope These Terms govern access to and use of the DAFE website, web application, progressive web application and associated services. They apply to both Free and Pro users. Additional terms may apply to specific services, including the DAFE Affiliate Program. If mandatory consumer-protection law applicable in a user's country grants rights that cannot legally be limited by these Terms, those mandatory rights remain unaffected. ## 3. Eligibility DAFE is intended for persons aged 18 or older who have the legal capacity to enter into a binding contract. You may not create or use a DAFE account if you do not meet the minimum legal age required to enter into this agreement in your jurisdiction. DAFE is not intended for children. ## 4. Nature of the DAFE Service DAFE is a trading journal, trading-psychology, analytics, education and self-reflection platform. Depending on the selected plan, DAFE may provide functionality including: - trading journals - trade statistics - strategy tracking - behavioral and emotion tracking - pre-trade self-checks - progress tracking - goals and motivation tools - notes - weekly reviews - AI-generated coaching reports - AI data analysis and AI chat - market-news and economic-event information - generated trade highlight videos DAFE does not execute trades and does not hold, manage or invest customer funds. DAFE is not a broker, exchange, portfolio manager, copy-trading provider or investment-advisory service. ## 5. No Financial or Investment Advice Nothing provided through DAFE constitutes financial advice, investment advice, trading advice, a personal recommendation, a trading signal, legal advice or tax advice. Information displayed by DAFE is provided for journaling, analytical, educational and self-reflection purposes. DAFE does not instruct users to trade with real money. Users may use DAFE in connection with demo, paper, simulated or live trading at their own independent discretion. Every decision to enter, modify, maintain or exit a trade is made solely by the user. ## 6. Trading Risk Trading and investing can involve substantial financial risk. Depending on the product traded, leverage and market conditions, users may lose some or all capital committed to trading and may in some circumstances incur additional obligations. Past results, win rates, journal statistics, strategy statistics, AI analysis and historical patterns do not guarantee future results. The fact that DAFE identifies a historical pattern or correlation does not mean that the same pattern will continue. Users are responsible for understanding the risks of any financial product they choose to trade. ## 7. Account Registration To use certain DAFE features, users must create an account. Users agree to provide information that is accurate and reasonably up to date. Each user is responsible for: - maintaining the security of account credentials - protecting access to authentication devices - using Two-Factor Authentication where appropriate - immediately notifying DAFE of suspected unauthorized access Accounts may not be sold, transferred or shared in a manner that violates these Terms. ## 8. Free Plan DAFE may offer a Free Plan with limited functionality. The exact features available in the Free Plan are shown on the current DAFE pricing or feature pages. Features identified as Pro-only require an active Pro entitlement. DAFE may prospectively modify the features included in the Free Plan. Such changes do not affect mandatory consumer rights. ## 9. Pro Plans DAFE currently offers: Pro Monthly: USD 15 per month Pro Yearly: USD 120 for the initial 12-month term There is currently no free trial unless a specific promotion expressly states otherwise. Pro Yearly is offered for an initial fixed term of 12 months at the price displayed at checkout. Unless the user cancels before the end of the initial term, the subscription does not renew for another fixed annual term. Instead, following the initial 12-month term, the subscription continues for an indefinite period on a month-to-month basis at the monthly continuation price disclosed at checkout (currently USD 15 per month). Before checkout is completed, the user must be shown the final applicable price, the renewal/continuation conditions, and any taxes or charges that apply. If the production Stripe prices differ from the prices stated above, DAFE will not silently publish inconsistent terms. The pricing mismatch is flagged internally as a Legal Launch Blocker and the documents are updated only after the actual commercial price is confirmed. ## 10. Taxes Prices may be subject to VAT, sales tax or similar taxes depending on the customer's location and applicable law. The amount actually charged, including the treatment of applicable tax, must be clearly displayed during checkout. DAFE does not represent that all displayed prices include tax unless the checkout expressly states that tax is included. ## 11. Formation of the Contract Before submitting a paid order, users must be given a reasonable opportunity to review and correct their order information. The checkout must clearly display: - selected plan - price - billing frequency - applicable taxes where required - renewal conditions - cancellation information - payment method - required legal information The final checkout action must clearly indicate that placing the order creates a payment obligation. After successful completion of the order, DAFE or its payment provider will provide an electronic confirmation. ## 12. Payments Paid subscriptions are processed through DAFE's payment provider. DAFE should not store complete payment-card numbers or card security codes where those details are handled directly by the payment provider. A subscription becomes active only after successful payment confirmation or another valid Pro entitlement has been granted. If payment fails, DAFE may suspend paid functionality until payment is successfully resolved. ## 13. Subscription Renewal and Continuation DAFE Pro Yearly is offered for an initial fixed term of 12 months. The fee for that initial term is the price displayed at checkout. Unless the user cancels before the end of the initial term, the subscription does not renew for another fixed annual term. Instead, following the initial 12-month term, the subscription continues for an indefinite period on a month-to-month basis at the monthly continuation price disclosed at checkout. During this rolling monthly continuation, the user may cancel at any time. Cancellation takes effect at the end of the current paid monthly billing period and no further recurring payment will be charged after that date. A user may request cancellation of the Yearly subscription at any time during the initial 12-month term. In that case, the user's paid Pro access continues until the end of the initial term, after which the subscription ends and the monthly continuation does not begin. Pro Monthly is billed monthly and renews monthly until cancelled. It may be cancelled at any time; cancellation takes effect at the end of the current paid monthly billing period and no further recurring payment will be charged after that date. DAFE does not use a renewal mechanism that binds a consumer to another fixed annual term merely because the consumer failed to cancel. This global model applies to all customers regardless of country, unless mandatory local consumer law grants the consumer even stronger rights. Mandatory consumer rights, including statutory withdrawal rights, remain unaffected. ## 14. Cancellation Users may cancel an active subscription through: Settings - Billing or through another legally required cancellation function provided by DAFE. Unless mandatory law or the checkout provides otherwise: - cancellation stops future renewal - previously paid access continues until the effective end of the paid billing period - the account is not charged again after the subscription has ended DAFE must provide clear confirmation of the cancellation request and the effective termination date. Cancellation does not remove statutory refund, withdrawal or consumer rights. ## 15. Statutory Withdrawal Rights Consumers may have statutory rights to withdraw from online contracts. These rights differ by jurisdiction. Consumers in the European Union or European Economic Area may generally have a 14-day statutory withdrawal period for distance contracts for services, subject to applicable statutory rules and exceptions. Any legally required withdrawal right applies independently of these Terms. DAFE must provide required withdrawal information and any legally required electronic withdrawal mechanism. Further details are provided in the DAFE Subscription, Cancellation & Withdrawal Policy. ## 16. Refunds Except where a statutory withdrawal right, consumer remedy, refund obligation or other mandatory legal right applies, subscription payments are not automatically refundable solely because a user stops using DAFE before the end of an already paid billing period. This clause does not limit mandatory consumer rights concerning: - withdrawal - failure to provide the service - lack of conformity - duplicate billing - unauthorized billing - other statutory remedies ## 17. Changes to Prices DAFE may change future subscription prices. Price changes do not retroactively change fees already paid. Where applicable law requires notice before a change applies to an existing subscription, DAFE will provide the required notice. If applicable law grants a termination right because of the price change, that right remains unaffected. ## 18. AI Features Certain DAFE features use artificial intelligence or automated analysis. These features may include: - AI Data Chat - AI Coaching Reports - AI Weekly Coaching Summaries - automated behavioral insights AI outputs are generated automatically and may contain errors, incomplete interpretations or incorrect conclusions. AI output is not financial, investment, legal, tax, medical or psychological advice. Users must independently evaluate AI-generated information. ## 19. Psychology Features DAFE provides tools for trading-related self-reflection, including emotions, discipline, behavioral patterns and pre-trade self-checks. These features are not clinical services. DAFE does not provide: - psychological diagnosis - psychotherapy - psychiatric treatment - medical diagnosis - mental-health treatment Any score or behavioral insight generated by DAFE is intended only for trading-related self-reflection. ## 20. Market Information DAFE may display market news, economic events, Bank Holidays, impact indicators and related market information. Such information may originate from third-party providers. Market information may be: - delayed - incomplete - unavailable - incorrectly classified - inaccurate Users must independently verify market-sensitive information before relying on it for any trading decision. DAFE does not guarantee that market information is real-time or error-free. ## 21. User Content Users retain ownership of original content they submit to DAFE. This may include: - journal entries - notes - strategy descriptions - screenshots - images - goals - comments - AI prompts By uploading or entering content, users grant DAFE a limited, non-exclusive licence to host, store, process, reproduce and technically transform that content solely to the extent reasonably necessary to provide the DAFE service. This includes, where applicable: - displaying the content back to the user - calculating analytics - generating requested AI analysis - producing requested trade highlight videos - creating backups - performing security and technical operations DAFE does not acquire ownership of the user's original content merely because it is uploaded to DAFE. ## 22. Rights to Uploaded Content Users may only upload material that they are legally entitled to use. Users are responsible for ensuring that screenshots, photographs, images, text and other uploaded materials do not unlawfully infringe third-party rights. DAFE may remove content where reasonably necessary to comply with law or protect third-party rights. ## 23. Trade Highlight Videos DAFE may generate short Trade Highlight Videos using trade data, visual templates and approved background media. Where DAFE provides a generated video for download, the user may use the downloaded video for personal sharing and on the user's own social-media accounts, subject to: - these Terms - applicable copyright law - third-party platform rules - any restrictions attached to licensed media used in the video DAFE verifies that it holds sufficient rights to every background clip used in generated videos for commercial use, server-side generation, user download and social-media reposting before this feature is activated in production. Where such rights cannot be verified, the feature is flagged as a Legal Launch Blocker and is not offered until resolved. A Trade Highlight Video is not proof of profitability or future performance. ## 24. Intellectual Property DAFE and its licensors retain all rights in: - DAFE branding - logos - application software - interface design - proprietary visual assets - original DAFE content - databases and data structures to the extent protected by law Users may not unlawfully copy, resell, reproduce, impersonate or commercially exploit protected DAFE material without authorization. Mandatory rights under applicable law remain unaffected. ## 25. Acceptable Use Users must not: - attempt unauthorized access to DAFE systems - circumvent subscription restrictions - access another user's data - interfere with platform security - upload malicious code - abuse APIs or automated systems - use DAFE for unlawful activities - impersonate DAFE - intentionally attempt to manipulate analytics or affiliate systems through fraud ## 26. Third-Party Services DAFE depends on third-party technology providers for certain functions. These may include payment processing, hosting, authentication, AI processing, email delivery, file storage, market information and other infrastructure. DAFE remains responsible for its own obligations under applicable law but cannot guarantee uninterrupted availability of independent third-party infrastructure. Mandatory consumer rights remain unaffected. ## 27. Availability DAFE aims to provide reliable access but does not guarantee uninterrupted or error-free availability. Maintenance, security incidents, network interruptions, provider outages or technical failures may temporarily affect the service. Nothing in this clause excludes remedies that consumers are entitled to under mandatory law. ## 28. Service Updates and Changes DAFE may update or improve the service. Changes may include security updates, feature improvements, technical adjustments or changes necessary to comply with law. For consumers protected by laws governing digital services, DAFE will respect any mandatory rights concerning material modifications, conformity, notice and termination. ## 29. User Responsibility for Data DAFE analytics depend substantially on information recorded by the user. Incorrect, missing or inconsistent data may result in inaccurate: - PnL calculations - win rates - strategy comparisons - emotional patterns - AI reports - behavioral analysis Users should verify their recorded information. ## 30. Suspension DAFE may reasonably suspend access where necessary because of: - security threats - unauthorized access - fraud - abuse - material violation of these Terms - unlawful activity - payment failure affecting paid access Any suspension will be proportionate to the circumstances and subject to mandatory consumer rights. ## 31. Termination and Account Deletion Users may stop using DAFE at any time. Subscription cancellation and account deletion are separate actions. Deleting an account may terminate access to DAFE product data. Where there is no continuing lawful reason to retain data, DAFE will delete or irreversibly anonymize personal data in accordance with the Privacy Policy. Some records may need to be retained for legal, tax, accounting, fraud-prevention or dispute-resolution purposes. Such retained information is restricted to those purposes and is not restored into a newly created DAFE account. ## 32. Statutory Consumer Rights Nothing in these Terms limits rights that cannot legally be excluded or restricted. For consumers protected by mandatory rules relating to digital content or digital services, rights regarding provision, conformity, repair, price reduction, termination or reimbursement remain unaffected. ## 33. Liability DAFE is responsible for liability to the extent required by applicable law. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. In particular, these Terms do not exclude liability for intentional misconduct or gross negligence where liability cannot legally be excluded. To the maximum extent permitted by applicable law, DAFE is not responsible for trading losses or investment losses resulting from decisions independently made by the user. To the maximum extent permitted by applicable law, DAFE is also not responsible for losses caused solely by a user's reliance on: - AI-generated analysis - historical analytics - strategy statistics - third-party market data - incomplete or inaccurate user-entered information Mandatory consumer remedies remain unaffected. ## 34. Privacy Personal-data processing is described in the DAFE Privacy Policy. The Privacy Policy is an information notice and does not itself provide unlimited consent to process personal data for unrelated purposes. Where specific consent is legally required, DAFE will request it separately. ## 35. Electronic Communication Users agree that DAFE may provide contractual and service-related communications electronically, including through: - email - account notifications - in-app notices Optional marketing communications require any consent mandated by applicable law. ## 36. Changes to These Terms DAFE may update these Terms to reflect legal, security, technical or product changes. Material changes will be communicated where required. Where applicable law requires renewed agreement, DAFE will request renewed acceptance. Changes will not retroactively remove mandatory rights. ## 37. Governing Law These Terms are governed by Swiss law to the extent that a valid choice of Swiss law is permitted. If a consumer is protected by mandatory consumer law in the country of their habitual residence, the choice of Swiss law does not deprive that consumer of mandatory protections that cannot lawfully be waived. ## 38. Jurisdiction Any jurisdiction clause applies only to the extent legally permitted. Mandatory consumer jurisdiction rules remain unaffected. ## 39. Severability If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law. The invalid provision will not be interpreted in a way that reduces mandatory consumer rights. ## 40.
